1. Acceptance of Terms

By accessing and using ShopBySnap ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.

2. Description of Service

ShopBySnap is a visual shopping assistant that:

  • Allows users to upload product photos.
  • Uses image recognition to search for similar products on AliExpress.
  • Provides curated product recommendations with affiliate links.
  • Displays pricing, ratings, and product information.

3. How Our Service Works

3.1 Image Upload

  • You upload a photo of a product you want to find.
  • Our system processes the image in real-time.
  • The image is sent to the AliExpress API for product matching.
  • Images are processed in memory and discarded immediately after results are generated. We do not store them.

3.2 Product Results

  • We provide product recommendations in categories: Best Match, Lowest Price, Top Rated, Hot Seller, Smart Choice.

Important Disclosure:

  • All product links provided are affiliate links.
  • We earn a commission when you make a purchase through our links.
  • This does NOT increase the price you pay.
  • Commission helps us keep the service free.

4. User Responsibilities

4.1 Acceptable Use

You agree to:

  • Only upload images you have the right to use.
  • Not upload illegal, harmful, or offensive content.
  • Not attempt to abuse, exploit, or reverse-engineer our service.
  • Not use automated tools to scrape or access our service.

4.2 Prohibited Content

You may NOT upload images containing:

  • Illegal products or counterfeit goods.
  • Weapons, drugs, or prohibited items.
  • Content that violates intellectual property rights.
  • Offensive, discriminatory, or harmful material.
  • Personal information of others.

4.3 Age Requirement

You must be at least 16 years old to use this service.

5. Intellectual Property

5.1 Your Content

  • You retain ownership of images you upload.
  • By uploading, you grant us a temporary, worldwide license to process the image for search purposes.
  • This license ends immediately when the image is discarded after processing.

5.2 Our Service

  • The ShopBySnap name, logo, and interface design are our property.
  • You may not copy, reproduce, or create derivative works.
  • All rights not expressly granted are reserved.

6. Third-Party Services

6.1 AliExpress

  • Product information comes directly from AliExpress.
  • Purchases are made directly on AliExpress.
  • AliExpress Terms of Service apply to all purchases.
  • We are NOT responsible for AliExpress products, shipping, or services.
  • Our service contains links to AliExpress and other third-party sites.
  • We are not responsible for external content or services.

7. Disclaimers and Limitations

7.1 No Warranties

Our service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including but not limited to:

  • Accuracy of product information.
  • Availability of products.
  • Price accuracy.
  • Search result quality.
  • Uninterrupted service.

7.2 Product Information

  • Prices, availability, and descriptions come from AliExpress API.
  • Information may be outdated or inaccurate.
  • Always verify details on AliExpress before purchasing.
  • We do NOT guarantee product quality, delivery, or seller reliability.

7.3 Not Product Endorsement

  • Displaying products does NOT constitute our endorsement.
  • We don't test, verify, or guarantee product quality.
  • Purchase decisions are your sole responsibility.

8. Limitation of Liability

To the maximum extent permitted by law:

8.1 We Are NOT Liable For:

  • Product quality, safety, or fitness for purpose.
  • Delayed, damaged, or non-delivered orders.
  • Disputes between you and AliExpress sellers.
  • Service interruptions or errors.
  • Any indirect, incidental, or consequential damages.

8.2 Maximum Liability

Our total liability to you shall not exceed €10 (ten euros).

9. Indemnification

You agree to indemnify and hold harmless ShopBySnap from any claims, damages, or expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Content you upload.

10. Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Modifications to Service

We reserve the right to modify or discontinue the Service at any time, change features, functionality, or availability, and update these Terms.

We may suspend or terminate your access if you violate these Terms, abuse the Service, or engage in fraudulent activity.

13. Geographic Restrictions

  • Our Service is primarily intended for users in the European Union and North America.
  • If you access from other locations, you do so at your own risk.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

14.2 Dispute Resolution

  • EU users may use the EU Online Dispute Resolution platform: ODR Platform
  • Legal disputes shall be resolved in the competent courts of Mińsk Mazowiecki, Poland.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
